Didn't know that either and if common sense was applied to situations like this
then it could never happen. Surely then, taking it a step further, if the Insurance
paid out and sued the original owner, whats to stop the original owner in turn recouping
his loss from the uninsured buyer of the bike? Its totally ridiculous if a person who
at worst committed an oversight gets punished more than someone who injures/kills
someone on an uninsured vehicle.

There is no such thing as common sense now a days unfortunately, and yes the insured party would have to pursue the new owner of the vehicle who was not insured to try to reclaim any of his losses. Problem is does the new owner of the vehicle (the un insured one) have any funds to go against.
Would the insured persons insurance company assist in any litigation ? Would the insured have a case against his insurance company if he was not informed of that clause or like most of us we never read the small print
