Hi Paul,PaulinBont wrote:The secrecy gets me ie in the case of Sarn Helen the advice is to ride it and if prosecuted they will defend in court but the TRF will not say why they believe that Sarn is legal, or even share that 'evidence' with members.
I would prefer that they hammer it out in discussions with the National Park Authority rather than wait until the Summons arrived in my post.
However, that evidence has been collected over the years...but it is very complicated...Sarn is not, legally, one continuous route...evidence has to be in place for every section of the route...it changes every time it crosses a 'higher' route. To be valid in court the evidence has to be presented properly, which would not be likely to happen if it was placed in an open source. It has never been presented in court, so it's not in the public domain.
We'd all like to be able to sit down with the NPA and hammer things out, but they won't talk to us, and they wouldn't even talk to my then WAM, who is one of the most important politicians in Wales.
I have done extensive work which reveals that the 'no vehicles' signs on various parts of Sarn do not have legal authority. If you are stopped on Sarn and it is suggested that you have committed an offence by passing the sign, I suggest you ask the following.
Can you have a copy of the Traffic Regulation Order which authorised its erection?
(there isn't one, therefore the sign is illegal)
and if the person who stops you is in charge of a motor vehicle (for example, an NPA pick-up truck), point out that if you have committed an offence by passing the sign then so have they as there is no exemption plate below the sign (stating, for example, 'except authorised vehicles').

Thank you Richard; I am being pedantic now but only a warranted Police Constable can 'stop' you. Wardens do not have the power to stop (detain).
As an aside, neither do the drivers employed by the Defence Estates up on Epynt Ranges.
I will only stop for uniformed police constables. (thumbs)

Nice to see you on here Richard, do you care to comment on what is happening within the TRF at the moment?

Hi Bob,
I'm really not involved in it other than as a card-carrying member ATM. I haven't even attended a Group meeting since I moved house a year ago. There are times in life when motorcycling takes a bit of a back seat, and this is one of them.
In other news...I'm now living with a very lovely woman who was my best friend/girlfriend when I was 17, and seem to have acquired 3 step-daughters, 3 step-grandchildren, and a lurcher called Bryn!
Life has never been better B)

Re: TRF becomming Extinct?
You are right about the 'power to stop' Paul.
I stop for pretty much anyone I pass...usually just to say 'Hello'.
On a couple of occasions, I've stopped for farmers, and the conversation has concluded along the lines of: "Oh, you seem sensible, you can ride any of the tracks on this land!"
If on the CCM, it's surprising how many conversations with male ramblers switch to the topic of 'CCM scramblers, John Banks, Vic Eastwood, Bob Wright et al." Funny to see their wives rolling their eyes in the background!

Wouldn't rely on PM's on this forum, there's no notification that you have one. I've found messages months old and I never knew they were there.MikeIrving wrote:i asked him direct Bob with a PM but up until now i have not not had an answer. I hope it isn't as it would be a very low down thing to do on his part..

Re: TRF becomming Extinct?
If as stated the signs are not legally placed they can legally be removed by anybody, can they not [theoretically speaking]?
