Unless you didn't remove them, just took them down and placed them on the floor, but then that would probably be criminal damage.

So - (pedantically here) you might have a lawful excuse, if the sign was not lawful - AND - if you took the sign down very carefully, unbolted it nicely, and placed all the parts in a nice box, with a polite note.... Then it would be hard to prosecute you wouldn't it?

It wouldn't be destroyed, it wouldn't be damaged and you could argue that you have a lawful excuse :laugh:

How would it be criminal damage it is allegedly, not a legally authorised sign post.It would be the same as someone removing say a poster for a local gig fastened to the traffic lights?

I imagine that the only person who can legally remove anything from a piece of land, or a building, is the legal owner...even if the 'thing' has been put there illegally in the first-place. I think this is covered by the law of Trespass which covers access to the land and possessions on it.

Yes, I suspect you are probably right. I had an upset neighbour last week because I removed all his trellis and rose bushes and his hanging baskets from his side of my fence, and moved his ladders and wheelbarrow that were leaning on it. He had quite a significant weight hanging off the fence, and the fence came down in the wind while he was on holiday. So I had the fence re-erected (at my cost, my fence, my problem) and he came home to find his hanging baskets by his garage door and the rose bushes lying on the floor, but undamaged.

I googled it and two things came up, firstly him putting nails and screws for the trellis and hanging baskets in the fence amounted to criminal damage, and then growing stuff up the fence without permission came under trespass laws.

He had permission from the previous occupier of the house, but they were a tenant, not the owner and caused a lot more damage than that to the property themselves and didn't care about the fence so just said, yeah no problem, so strictly speaking he never had permission in the first place.

He's now trimmed the rose bushes right back and supported them with garden canes.

^...yes, a Tenant cannot carry out or give permission for any works to be carried out to a property that they rent unless that is specifically allowed in their tenancy agreement. The Landlord, i.e. the owner, is the only one who can.

Some prick keeps putting up a sign (with fake police details on it) at the bottom of one of the lanes at the back of Llangollen. We keep tearing it down (the lane is perfectly legal)
